Son of Mark and Isabella B. Rutherford of Union St. Carmarthen husband of the late Annie Addison Rutherford (formerly Proudfoot). As a solicitor, he was Admitted in April 1907 and was a Member of Postlethwaite & Rutherford of Leeds.Service Life:

20 July - 2 August 1918. French intelligence reports suggested a weakness in the German position on the Marne and accordingly two British Divisions were ?loaned? to the French to help their attack. The outcome was entirely successful and the Germans were driven back about four miles. The British Divisions (51st Highland and 62nd West Riding) suffered about 6000 casualties

He enlisted in 1916 into the Scots Guards and served fourteen months in the ranks. Gazetted 2nd Lieutenant Tank Corps; Captain. He was killed in action on the 23rd July 1918 aged 34.
His death is first seen reported in the newspapers in the Shepton Mallet Journal on the 2nd August 1918, "Killed in France, on the 23rd inst., Captain Mark Rutherford, Tank Corps, son-in-law of Mr. and Mrs. Proudfoot, Woodbourne House, Shepton Mallet, aged 34 years."
Yorkshire Post and Leeds Intelligencer of the 16 August 1918 reports, "CAPT. MARK RUTHERFORD, of Leeds, has been officially reported killed in action on July 23. He was 34 years of age. Early in 1916 he voluntarily enlisted in the Scots Guards, and after 14 months in the ranks, entered a cadet corps, volunteered for the tanks and as second-lieutenant took an active part in the memorable attacks on Cambrai, for his gallant service in which he received his captaincy. Previously to joining the Army Mr. Rutherford was sole partner of the firm of Postlethwaite and Rutherford, solicitors, East Parade, Leeds, and a director of the firm of Crowe and Company (Limited). He gained second place in the First Class at the Honours Law Examination, January, 1907, was awarded the Clifford's Inn Prize, and admitted a solicitor in April, 1907, at the early age of 22. He leaves an orphan boy of three years."
He was also mentioned in the Shields Daily News a week later on the 22nd August 1918, "Capt. Mark Rutherford, Tank Corps (killed in action) was the second son of ex-Police Superintendent and Mrs Rutherford, West End, Tweedmouth. He was 34 years of age, and in civil life was a solicitor, being sole partner of the firm Postlethwaite and Rutherford, Leeds. He served 14 months in the ranks before taking a commission."
